1. Introduction

Welcome to NextOf – Secure Estate Planning ("NextOf", "we", "us", "our").

NextOf is operated by ELEVATE STRATEGY CONSULTING SDN. BHD. (Company Registration No. 202001024426), a company incorporated in Malaysia.

These Terms & Conditions govern your access and use of the NextOf platform, including our website, applications, and services (collectively, the "Service").

By creating an account or using NextOf, you agree to be bound by these Terms.

2. Definitions

  • "NextOf" refers to the digital platform operated by Elevate Strategy Consulting Sdn. Bhd.
  • "User" refers to any individual using the Service
  • "Service" includes all features such as asset organisation, will generation, and related services
  • "Trusted Persons" refers to individuals designated by the User for access permissions
  • "Legal Professionals" refers to independent licensed lawyers engaged through or alongside the platform

3. Nature of Service (Important)

NextOf provides a digital platform to assist users in:

  • Organising financial and personal information
  • Generating draft will documents based on user inputs
  • Facilitating optional review by independent licensed legal professionals

NextOf does not act as a law firm and does not provide legal advice.

Any legal advice, validation, or execution of a will / wasiat is conducted solely by independent licensed lawyers, and any lawyer-client relationship exists strictly between the User and the lawyer.

When using the will / wasiat generation feature:

  • The will / wasiat is generated based entirely on User-provided information
  • NextOf does not verify completeness, accuracy, or legal validity
  • Users are responsible for ensuring correctness of all inputs

If a User opts for lawyer review:

  • The lawyer is an independent third party
  • Fees (if any) will be disclosed separately
  • NextOf is not responsible for legal advice provided, final enforceability of the will / wasiat, or execution, witnessing, or filing

5. Eligibility

You must:

  • Be at least 18 years old
  • Provide accurate and truthful information
  • Have legal capacity to enter into this agreement

6. User Responsibilities

You agree to:

  • Maintain confidentiality of your account credentials
  • Ensure all information provided is accurate and up to date
  • Obtain consent from any Trusted Persons added to the platform
  • Use the platform lawfully and responsibly

You are solely responsible for all data you provide.

7. Trusted Access & Permissions

NextOf enables Users to assign access to Trusted Persons.

By using this feature:

  • You confirm that consent has been obtained
  • You control access rules and permissions
  • NextOf does not verify relationships or intent

NextOf is not liable for misuse of access or disputes between Users and third parties.

8. Data Security & Platform Safeguards

NextOf implements industry-standard safeguards, including:

  • Encryption (in transit and at rest)
  • Secure authentication systems
  • Access control and monitoring

However, no system is completely secure. Users acknowledge inherent risks of digital platforms.

9. Subscription & Fees

Certain features may be offered on a paid basis.

  • Pricing will be clearly disclosed
  • Payments are non-refundable unless stated otherwise
  • Pricing may be updated with notice

10. Intellectual Property

All platform content, systems, and branding are owned by NextOf.

You may not:

  • Copy, reproduce, or distribute platform content
  • Reverse engineer or misuse the system

11. Limitation of Liability

To the fullest extent permitted by law, NextOf shall not be liable for:

  • Invalid or unenforceable wills
  • Errors arising from User-provided information
  • Legal outcomes, disputes, or claims
  • Actions or advice from independent legal professionals
  • Loss of data, assets, or financial information

The Service is provided on an "as-is" and "as-available" basis.

12. Corporate Entity Clarification

All services under NextOf are operated by:

ELEVATE STRATEGY CONSULTING SDN. BHD.

"NextOf" refers to the platform and brand, and not a separate legal entity unless otherwise stated.

13. Governing Law

These Terms are governed by the laws of Malaysia.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of updated Terms.
